Hi,

I agree with the proposed method. Without respecting a VBV - which is 
how x264 is mostly used - there isn't much you can do anyway.

The proposed alternative (a posterio respecting the max bitrate) will 
not avoid the pitfall you want to prevent, since I think lots of HD 
movie will have a max bitrate higher than 50 Mbits, while most STB will 
limit implicitely or explicitely to level 4.1.
